1. Acceptance of these Terms
These Terms govern your access to and use of Hbarter, including wallet authentication, profiles, listings, offers, Smart Trade Matches, notifications, token association checks, and Secure Swap coordination.
By accessing an authenticated feature, creating a listing, submitting an offer, or approving a Hbarter-related wallet request, you agree to these Terms, the Privacy Policy, and the Risk Disclosure. If you do not agree, do not use Hbarter.
Hbarter is operated under the public project name “Hbarter” by an independent individual maintainer. Questions and formal notices may be sent to hbarter.app@gmail.com. Additional identity or address information will be provided where applicable law validly requires it.
2. Independent, community-maintained project
Hbarter was created as an independent community tool intended to help Hedera NFT users coordinate direct swaps — trading NFTs and, when HBAR offers are turned on, accepting HBAR instead of NFTs — with clearer transaction steps. The Maintainer presently operates Hbarter as an independent, community-maintained project and does not present Hbarter as a company, investment product, financial service, or guaranteed scam-prevention service.
The community-maintained nature of the project does not change any rights or responsibilities imposed by applicable law. Nothing in these Terms determines the legal or regulatory classification of Hbarter, any NFT, or any activity.
Hbarter is not affiliated with, sponsored by, or endorsed by Hedera, HashPack, HashScan, any wallet provider, or any NFT project unless an authorized statement expressly says otherwise.
3. Eligibility and lawful use
You may use Hbarter only if you are at least 18 years old, have reached the legal age required to enter a binding agreement where you live, and are legally permitted to use self-custodial wallets and NFTs.
You may not use Hbarter if applicable law, sanctions, a court order, or another binding restriction prohibits you from doing so. You are responsible for legal, tax, reporting, intellectual-property, and regulatory obligations that apply to your activity.
4. Network and live-beta status
Hbarter operates only through Hedera Mainnet. You must verify the network shown in Hbarter and in your wallet before approving any request. Do not assume that an account, token, NFT, balance, or transaction on one network environment exists or has the same status on another.
Hbarter currently operates on Hedera Mainnet. Hbarter is production-hosted, and network behavior on this deployment does not guarantee how any other network environment behaves.
Hbarter is provided as a production-hosted service on Hedera Mainnet. Features, safeguards, fee handling, supported collections, infrastructure, and availability may change, be limited, or be discontinued. The Maintainer does not promise uninterrupted operation, permanent support, or a future feature or network release.
5. Wallet, authentication, and account responsibility
Authenticated features require a compatible Hedera wallet and a signed login message. You remain in control of your wallet and are responsible for reasonable protection of your device, browser, email, wallet access, private keys, recovery phrase, and passwords.
- Confirm that you are using the official Hbarter domain before connecting a wallet.
- Read the transaction type and every transfer before signing.
- Verify the network, account IDs, token IDs, serial numbers, recipients, and fees.
- Reject unexpected, unclear, or inconsistent wallet requests.
- Disconnect or secure an account or device that may be compromised.
Hbarter does not require, request, or store your private key or recovery phrase. Any person asking for those secrets is not following the Hbarter process.
These Terms do not automatically make you responsible for every unauthorized event. Responsibility depends on the facts and applicable law.
6. Smart Trade Matches
Wallet Matches and Mutual Opportunities are discovery signals generated from current wallet, project, and listing data. They can be incomplete, delayed, stale, or no longer actionable.
A Smart Trade Match does not guarantee ownership, availability, authenticity, legality, value, fairness, counterparty conduct, project quality, fee safety, token association, or successful completion. It does not create or accept an offer, reserve an NFT, or start a swap automatically.
7. Listings
A listing is an application record describing NFTs connected to your account and the project criteria you are willing to receive. Creating a listing does not transfer, escrow, reserve, or freeze an NFT on-chain.
By creating a listing, you represent that you control or are authorized to use the relevant account and NFTs, that submitted information is accurate, and that the listing does not violate law or another person's rights. External wallet activity can invalidate a listing at any time.
8. Offers and owner selection
An offer is an application record proposing a trade for a listing. An offer can propose NFTs or, when HBAR offers are turned on, HBAR; some listings may also let a buyer propose both as alternatives for the owner to choose between. A completed swap settles one type only — NFTs or HBAR — and never both together; combined NFT-and-HBAR settlement is not supported. Submitting, receiving, reviewing, or selecting an offer does not itself transfer any asset and does not guarantee completion.
The listing owner can compare the offers received and select one. When an eligible offer is selected, Hbarter may run token association and other checks and create a Secure Swap. The selected offer remains pending until the network confirms the trade.
9. Token association
A receiving account may need to associate with a token before it can receive that token's NFTs. Hbarter may check this while a user creates a listing, submits an offer, reviews an offer, or prepares a swap.
A Token Associate transaction is separate from the final NFT swap. It must be authorized by the receiving account, may incur a network fee, and changes that account's token associations. Hbarter may block or delay the related action until required checks pass.
10. Swap workflow
After an eligible offer is selected and required checks pass, Hbarter may coordinate the following process:
- Create a Secure Swap and application-level asset locks for the assets in the deal.
- Have each participant review the exact assets and sign in their own wallet within a signing window. With a Secure Swap, the two of you do not need to be online at the same time.
- Re-check ownership, project eligibility, token association, available balance where HBAR is involved, fee safety, session status, and expiry.
- Complete the trade on Hedera only after the required signatures and checks are satisfied, moving the agreed assets together with any applicable platform fee shown to you before signing, in one all-or-nothing transaction.
- Finalize application records only after confirmed success.
The intended exchange is completed on an all-or-nothing basis: it either completes in full or nothing moves. If the Secure Swap expires, is cancelled, or fails, no assets change hands. Hbarter does not guarantee that a session will reach completion or that a submitted transaction will succeed.
For a Choice Swap listing, only the NFTs selected in the accepted deal are included in the swap. Unselected NFTs stay with the owner and are not locked, transferred, or settled as part of that swap.
11. Wallet signatures
Each account sending assets must authorize the transfer from that account. Hbarter's own server keys may sign only to create, submit, and pay the network fee for the transaction; a server or fee-payer signature does not replace a participant's required authorization.
Hbarter may reject a signature or refuse submission when the signer, transaction body, network, session, ownership, association, fee, expiry, or security checks do not pass.
12. No custody, escrow, brokerage, valuation, or advice
- Hbarter does not store private keys or recovery phrases.
- Hbarter does not take custody of your NFTs or HBAR before the final transfer.
- Application-level locks do not place assets in escrow and are not on-chain freezes.
- Hbarter does not act as a broker, fiduciary, financial institution, investment adviser, tax adviser, appraiser, insurer, or asset-recovery service.
- Hbarter does not determine whether a proposed trade is fair, profitable, suitable, or in your best interests.
13. Fees and costs
Hedera transactions may incur network transaction fees, and NFT tokens may have creator-configured custom fees (including royalty or fallback fees). A separate Token Associate transaction may require the receiving user to pay a network fee.
On Hedera Mainnet, Hbarter currently charges a successful-swap platform fee of 2 HBAR per participant (4 HBAR in total per completed swap), paid to the Hbarter treasury. The platform fee is charged only when the swap succeeds — no platform fee is charged if a swap fails, expires, is cancelled, or is rejected. It is settled inside the same all-or-nothing swap transaction, is shown to you before you sign, and is separate from Hedera network fees and any collection royalty or custom fees. Any future change to the fee policy must be disclosed before it applies. You remain responsible for reviewing the fees shown before you approve a request.
14. Verified Projects
A Verified Project is a collection included in Hbarter's registry for platform eligibility based on the checks performed. Verification is limited and can become outdated.
Verification is not an audit, endorsement, identity guarantee, authenticity guarantee, legal opinion, security guarantee, or recommendation. Verification does not guarantee value, liquidity, project conduct, creator conduct, metadata accuracy, or the safety of external links.
15. Profiles, links, and user content
You retain rights you hold in profile text, images, links, and other content you submit. You grant the Maintainer a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and distribute that content only as reasonably necessary to operate, secure, and present Hbarter.
You represent that you have the right to submit the content and that it is not unlawful, misleading, malicious, infringing, or harmful. Hbarter may remove or restrict content that creates legal, security, or operational risk.
16. Prohibited conduct
You must not use Hbarter to:
- Commit or facilitate fraud, theft, phishing, impersonation, money laundering, sanctions evasion, market manipulation, or other unlawful conduct.
- Use another person's wallet, identity, content, or assets without authorization.
- Submit malicious code, harmful links, unlawful content, or infringing material.
- Manipulate listings, offers, matches, notifications, analytics, or activity records.
- Bypass authentication, authorization, rate limits, ownership checks, fee checks, association checks, or swap safeguards.
- Probe, scrape, reverse engineer, overload, disrupt, or interfere with Hbarter or its providers, except to the limited extent a non-waivable legal right permits.
- Misrepresent affiliation with Hbarter, Hedera, a wallet provider, a project, or another user.
17. Third-party services and content
Hbarter depends on independent wallet, Hedera network, Mirror Node, explorer, hosting, database, email, monitoring, project, and external-link providers. The Maintainer does not control their terms, privacy practices, availability, security, content, or decisions.
A link, integration, registry entry, or technical dependency does not mean that a third party endorses Hbarter or that Hbarter endorses every statement or action of that third party.
18. Availability, changes, suspension, and discontinuation
Hbarter is provided on an as-available basis by an individual community maintainer with limited time, resources, support capacity, and recovery capability. Features may be delayed, limited, changed, suspended, or discontinued for maintenance, security, legal, provider, cost, personal-availability, or technical reasons.
Hbarter may block or remove a listing, offer, project, account action, signature, transaction, or feature when a required check fails or when reasonably necessary to protect users, the service, or third parties. Advance notice is not guaranteed where immediate action is reasonably required.
19. Privacy
The Privacy Policy explains information processed by Hbarter, public blockchain data, service providers, security logs, Smart Trade Match records, retention, and user requests. By using Hbarter, you acknowledge that blockchain records can be public and cannot be deleted by the Maintainer.
20. Enforcement and account restrictions
Hbarter may restrict authenticated access, remove content, reject an action, preserve evidence, or report suspected unlawful conduct when reasonably necessary to enforce these Terms, protect users or systems, comply with law, or investigate abuse.
A restriction does not create a duty to monitor all users, projects, content, wallets, or external activity. Hbarter does not guarantee that every scam, abuse attempt, compromised account, or harmful link will be detected.
21. Acknowledgement of risk
You acknowledge the risks described in the Risk Disclosure, including wallet compromise, phishing, wrong-asset approval, stale data, counterparty misconduct, project failure, third-party outages, token configuration, fees, expiry, software defects, public-ledger exposure, legal uncertainty, and irreversibility.
To the fullest extent permitted by law, you voluntarily decide whether to use Hbarter and whether to approve each wallet action after reviewing it. This acknowledgement does not waive rights or liabilities that cannot lawfully be waived.
22. Events outside the Maintainer's reasonable control
To the fullest extent permitted by applicable law, the Maintainer is not responsible for loss caused by events outside reasonable control, including:
- Wallet, device, browser, extension, email, credential, or remote-access compromise.
- Phishing, fake websites, impersonation, malware, or malicious third-party content.
- Incorrect, unintended, or externally initiated transactions.
- Counterparty misconduct or off-platform communications and agreements.
- Project abandonment, metadata changes, token administration, or creator conduct.
- External transfers or account changes that invalidate application records.
- Network, wallet, Mirror Node, explorer, hosting, database, internet, or provider outages or failures.
- Changes in law, regulation, sanctions, taxation, market conditions, or third-party policies.
23. Disclaimers
To the fullest extent permitted by applicable law, Hbarter and the Maintainer provide the service as is and as available, without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, or successful completion.
Hbarter does not guarantee another user's identity or conduct, NFT authenticity beyond the checks performed, project legitimacy, value, liquidity, legal status, tax treatment, scam prevention, uninterrupted availability, or continued support.
24. Limitation of liability
To the fullest extent permitted by applicable law, Hbarter, the Maintainer, and project contributors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar losses, or for lost assets, data, profits, opportunity, goodwill, access, or expected value arising from or related to Hbarter, even if the possibility of loss was known.
To the fullest extent permitted by applicable law, the total aggregate liability of Hbarter, the Maintainer, and project contributors for claims arising from or relating to the service will not exceed the greater of the amount you paid directly to Hbarter for the relevant service during the twelve months before the event giving rise to the claim or US$100 (or its equivalent in local currency).
These limitations do not exclude liability or remedies that cannot legally be excluded or limited, including where applicable liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or non-waivable privacy and consumer rights.
25. Responsibility for third-party claims
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Maintainer and project contributors from third-party claims, losses, and reasonable costs arising from your unlawful use of Hbarter, infringement of another person's rights, unauthorized use of an account or asset, malicious content, or material breach of these Terms. This provision does not apply to the extent a claim was caused by conduct for which liability cannot lawfully be excluded.
26. Disputes and applicable law
Before starting formal proceedings, you are encouraged to send a written description of the dispute and requested resolution to hbarter.app@gmail.com, unless urgent relief or applicable law makes prior notice inappropriate.
These Terms do not invent a governing law, arbitration agreement, or exclusive court. Any dispute is governed by applicable law and may be brought before a court or authority that has lawful jurisdiction. Mandatory consumer, privacy, and other non-waivable rights remain unaffected.
27. Changes to these Terms
Hbarter may update these Terms when the service, risks, law, or operating model changes. The published Last updated date identifies the current version. Material changes may require renewed acceptance before continued use of authenticated features.
28. General terms
If a provision is held unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue where permitted. Failure to enforce a provision is not a waiver. You may not transfer your obligations under these Terms without permission, but the Maintainer may transfer operation of the project together with appropriate notice and privacy safeguards.
